These Terms of Service ("Terms") govern your access to and use of the mastOS platform and related services provided by Mast Labs LLC ("Mast Labs," "we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Services

mastOS is an AI-powered communications and orchestration platform designed for regulated environments. Services include multi-channel patient communication (SMS, voice, chat), AI routing and triage, PHI-safe data orchestration, and related infrastructure delivered via Microsoft Azure.

mastOS is deployed by organizations ("Clients") on behalf of their end users. If you are an end user receiving communications through a Client's program, these Terms apply to your interaction with mastOS-powered services.

2. SMS Terms

By opting in to an SMS program powered by mastOS, you agree to receive text messages from that program. Specifically:

  • You are consenting to receive automated SMS messages related to the program you enrolled in
  • Message frequency varies by program and your activity
  • Message and data rates may apply based on your carrier plan
  • To opt out, reply STOP to any message. You will receive a confirmation and no further messages will be sent.
  • To get help, reply HELP or contact the program administrator
  • Carriers are not liable for delayed or undelivered messages

3. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the platform or its infrastructure
  • Interfere with or disrupt platform services
  • Submit false or misleading information
  • Use the platform to transmit spam, malware, or harmful content
  • Reverse engineer, decompile, or attempt to extract source code

4. HIPAA and PHI

Where mastOS processes Protected Health Information (PHI) on behalf of a Client, Mast Labs operates as a Business Associate under HIPAA. All PHI processing is governed by a valid Business Associate Agreement (BAA) between Mast Labs and the applicable Client. End users with questions about their health information should contact the Client directly.

5. Intellectual Property

All platform technology, architecture, algorithms, models, and software comprising mastOS are the intellectual property of Mast Labs LLC. Nothing in these Terms grants you a license to Mast Labs' proprietary technology beyond the right to use the services as described.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MAST LABS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAST LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY THE APPLICABLE CLIENT IN THE THREE MONTHS PRECEDING THE CLAIM.

8. Indemnification

Clients agree to indemnify and hold harmless Mast Labs from any claims, damages, or expenses arising from their deployment of mastOS, their end users' use of the platform, or their violation of these Terms.

9. Termination

We reserve the right to suspend or terminate access to the platform for violation of these Terms, non-payment, or any conduct we determine to be harmful to the platform, other users, or Mast Labs. Upon termination, your right to use the platform ceases immediately.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Broward County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance. Material changes will be communicated to Clients.
